Agreement to Terms

By accessing or using ViewerQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users, including streamers and viewers.

Description of Service

ViewerQ provides a queue management system for Twitch and Kick streamers to organize viewer participation in games. Our service:

• Manages queues for viewer games via Twitch and Kick chat commands
• Facilitates random or sequential selection of viewers
• Integrates with Discord for voice channel invitations
• Provides a dashboard for streamers to manage their queues

Account Terms

• You must be at least 13 years old (or 16 in certain jurisdictions) to use this Service
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You may not use the Service for any illegal or unauthorized purpose
• One person may not maintain more than one account

Acceptable Use

You agree not to:

• Use the Service to harass, abuse, or harm others
• Attempt to gain unauthorized access to other users' accounts
• Use bots, scripts, or automation to manipulate queues
• Interfere with or disrupt the Service or servers
• Violate Twitch, Kick, or Discord's Terms of Service while using our Service
• Impersonate others or provide false information
• Use the Service to distribute spam or malicious content
• Attempt to reverse engineer or extract the source code

Streamer Responsibilities

As a streamer using ViewerQ, you:

• Are responsible for managing your queue and the viewers who participate
• Must ensure your Discord server's rules are followed
• Have the right to remove viewers from queues or sessions at your discretion
• Should inform your viewers about how you use ViewerQ
• Are responsible for compliance with Twitch, Kick, and Discord ToS in your channel/server

Third-Party Services

Our Service integrates with Twitch, Kick, and Discord. By using ViewerQ, you also agree to:

• Twitch Terms of Service
• Kick Terms of Service
• Discord Terms of Service

ViewerQ is not affiliated with, endorsed by, or sponsored by Twitch, Kick, or Discord.

Intellectual Property

The Service and its original content, features, and functionality are owned by ViewerQ and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without explicit permission.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of Twitch, Kick, or Discord ToS
• Harmful or abusive behavior toward other users
• Fraudulent or illegal activity

You may also delete your account at any time from the Settings page.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIEWERQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Indemnification

You agree to defend, indemnify, and hold harmless ViewerQ and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with applicable rules.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified by posting the new Terms on this page with an updated effective date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
